Primitive & Whimsical Graphics

Please take a moment or two to read and familiarize yourself with our Terms of Use before purchasing any graphics or services from our site. If you have any questions, concerns or need clarification on these terms, please feel free to email me. I believe that if you purchase graphics for a specific purpose you should be able to use the graphics for that intended purpose. I do not sell a commercial license but I do expect to be given credit for my work. (That is a common courtesy with which anyone would expect to be treated) With that in mind:

Me & Foxy McGee, herein after will be referred to as "MFM" and you will be known as "The Client". MFM retains all copyright to any and all original artwork, graphics,and designs provided by MFM, with the exception of original artwork that has been purchased for use from other graphic designers. In said cases the original artist will retain copyright to their work. The Client agrees to use MFM graphics, designs, services in the manner outlined, authorized and defined.
In the case of Premade Websets and Auction Templates: These graphics are solely for use upon your personal website. They may not be altered, duplicated, modified or resold or used to create new products for resale.
In the case of Graphic Singles, Collections, and Clipart: You may use these graphics to make different types of crafts, web graphics or desktop publishing projects for your personal use or for profit. Credit must be given to Me & Foxy McGee on all product packaging or websites where graphics are displayed.


CAS Graphic Installation/eStore Set-up and/or Maintenance
The Client agrees to provide MFM access to their eStore using their username and password. MFM will require access in order to upload and install graphics/provide setup and/or maintenance services. All Client information provided to MFM is kept strictly confidential and is not shared with anyone at anytime for any reason.


Copyright Infringement
The Client stipulates and agrees that any files, images or copy provided for use to MFM in the creative process by the Client is owned by The Client or The Client has obtained proper permission to use the files, images, or copy from the rightful owner; MFM does not accept any responsibility or liability associated with the use of said files, images or copy. The Client agrees to take full responsiblity from any suit or claim of copyright infringement that may arise if proper authorization has not been solicited from the rightful owner.


Credit Links
When the designs and/or services involved include webset graphics, webset design, logo design, auction templates, template customization, or eStore set-up/maintenance a credit link or "link back" to Me and Foxy McGee will be required. This link will be placed on your site's main index page and shall remain there until such time as all graphics have been removed from The Client's website.


Support
MFM agree to provide The Client with such support as may be necessary to ensure the purchased graphics or design services are fully functional as intended. The Client may be subject to additional fees if it is deemed that the project has exceeded reasonable edits or changes.


Payments
In cases of Premade graphics and custom designed graphics The Client agrees to pay MFM prior to graphics being released to The Client without embedded copyright watermarks. In cases of custom webset design and/or custom logo or any custom graphic design a non-refundable deposit will be required in advance by The Client before any work will commence, usually amounting to half of the agreed upon purchase price for the completed design. The balance due will be due upon completion of said work and prior to any release of custom designs to The Client. In cases of custom template design/customization or eStore setup, payment is required upfront before any work will commence.


Cancellation Policy
MFM reserves the right to cancel any services or designs at anytime without reason. Cancellations made by The Client require payment for any services already rendered. MFM makes a concentrated effort to meet ALL of The Client's needs. Should The Client cancel it is necessary that MFM be compensated for all work performed, up to and including at the time of cancellation. At such time, The Client agrees to forfeiture of any present or future claims of ownership to any and all completed designs and services, as well as the deposit previously paid, and all contractual agreements between MFM and The Client will be considered NULL and VOID.

Regardless of whether you have read the complete content of our Terms by purchasing services or designs from Me and Foxy McGee, you, The Client, agree to abide by all terms in their entirety.
